Supreme Court relief for IndiGo & SpiceJet: No retrospective IGST on reimported aircraft parts

The Supreme Court provided relief to InterGlobe Aviation and SpiceJet. It dismissed the customs department's appeal. The appeal sought integrated goods and services tax retrospectively. This was for re-import of aircraft parts after foreign repairs. The court stated that a 2021 notification could not retroactively impose IGST. This overruled the department's claim for taxes from 2017 to 2021.

In a relief to airlines InterGlobe Aviation and SpiceJet Ltd, the Supreme Court on Monday dismissed the customs department's appeal seeking to levy integrated goods and services tax (IGST) retrospective on reimport of aircraft or aircraft parts into India after their repairs outside the country.
