Maharashtra GST Department Arrests Trader For Creating Fake Invoices Worth Rs 130 Crore
The investigation conducted by the Pune Investigation Branch of Maharashtra State Tax Department revealed that Omprakash Tirathdas Sachdev acted as a director of M/s Shri Waheguru Global Mines Pvt Ltd. He also established and operated various other firms and companies in the name of third parties.
These are M/s Traders Bhavare, M/s Prakash Traders, M/s Agarwal Enterprises, M/s Kolhe Sales, M/s Kiran Trading Company, M/s Narayan Traders, M/s Kaashmora Trading Pvt Ltd, M/s Marikamba Trading Pvt Ltd, M/s Seosis Mines Pvt Ltd. Through these firms and companies, he had issued fake invoices of amount more than Rs 130.05 crore and passed on the Input Tax Credit of Rs 19.79 crores without actual delivery of the goods or services.
This has caused a serious loss of revenue to the government exchequer and this act constitutes an offence u/s 132(1) (b) and (c) under the Maharashtra Goods and Services Tax Act / Central Goods and Services Tax Act This offence is cognizable and non-bailable as per section 132(5) of the Act and punishable u/s 132(1)(i) which provides for imprisonment for a term up to 5 years. Hence, the said person Omprakash Tirathdas Sachdev has been arrested u/s 69 of the Maharashtra Goods and Services Tax Act, 2017 on Tuesday 22.06.2021. The person arrested has been sent to judicial custody till 06 July 2021 as per the orders of Chief Judicial Magistrate, Shivajinagar, Pune.
The investigation of the offence and arrest was conducted by Babasaheb Jumbad (Assistant Commissioner of State Tax) under the guidance of Dhananjay Akhade (Additional Commissioner State Tax, Pune Division), Reshma Ghanekar (Joint Commissioner of State Tax) and D B Deshmukh (Deputy Commissioner of State Tax).
