HC: Slum policy benefits not for those filing GST, ITR
Lucknow: The Lucknow bench of the Allahabad high court has made it clear that the benefits of the slum policy 2021 approved by the state govt cannot be availed by those who have commercial establishments in slum areas.
“Such persons cannot be put at parity with the term ‘slum dwellers’. Therefore, the court would identify and consider the case on the basis of their particular facts,” said the bench, hearing the Akbarnagar demolition case.
The bench of Justices Vivek Chaudhary and OP Shukla also directed the state govt, LDA and the petitioners to furnish the list of those dwellers, who file GST and Income Tax returns, along with the last two years’ details.
Earlier, arguing for the petitioners, around 800 of them who have moved the bench jointly or separately, senior advocate JN Mathur vehemently argued that since the state govt itself made a policy for slum dwellers in 2021, hence it cannot deviate from that policy and oust the dwellers of Akbarnagar without following the provisions of the policy.tnn
