CBIC exempts from maintaining deposits in ECL under Customs Act w.e.f. June 01, 2022
Background
Section 51A of the Customs Act, 1962 (“the Customs Act”) requires every assessee to maintain Electronic Cash Ledger (“ECL”) in the customs portal. Every deposit made towards duty, interest, penalty, fee, or any other sum payable by a person under the provisions of the Customs Act or under the Customs Tariff Act, 1975 (“the Customs Tariff Act”) or under any other law for the time being in force or the rules and regulations made thereunder, using authorized mode of payment shall, subject to such conditions and restrictions, be credited to the ECL of such person.
Notification:
The CBIC vide Notification No. 98/2022-Customs (N.T.) dated November 29, 2022 amended the Notification No. 47/2022-Customs (N.T.) dated May 31, 2022, by which the exemption that was granted from the deposits pertaining to all classes of persons and all categories of goods, from the provisions of Section 51A of the Customs Act with effect from June 01, 2022 upto November 29, 2022 has been extended upto March 31, 2023.
Therefore, the deposit pertaining to classes of persons and all categories of goods, from the provisions of the said section 51A are exempted from June 1, 2022 upto March 31, 2023.
