52nd GST Council Meeting: Recommends for Automatic Restoration of Provisionally Attached Properties

The Council recommended amendment in sub-rule (2) of Rule 159 of the CGST Rules, 2017 and FORM GST DRC-22 by stipulating that any order for provisional attachment in FORM GST DRC-22 will no longer remain valid after the passage of one year from the date of the initial order.

This amendment simplifies the process and facilitates the automatic release of provisionally attached properties after the completion of one year, eliminating the requirement for a separate, specific written order from the Commissioner to effect the release.

This change streamlines the procedure for the release of provisionally attached assets, offering more efficiency and clarity in compliance with GST regulations.
